Summary: On March 11, the Board voted to support Eagle Peak’s enrollment increase and retention of their 5th grade students. Eagle Peak has met with neighbors and City of Walnut Creek to ascertain any questions or concerns. Neither group had objection to the project. Pursuant to an agreement dated May 20, 2003 between District and the City of Walnut Creek, District provided notification of Eagle Peak’s intent to increase student capacity and compliance with applicable requirements.

As such, Eagle Peak wishes to reconfirm anticipated increase its enrollment for the 2013-14 school year by approximately 20-35 students. Doing so allows the school to accommodate its existing 5th grade students by adding a 6th grade. Eagle Peak’s current charter authorizes K-6 Grades. If the school adds 20-35 students, total enrollment will be approximately 213-223. Per discussion with city and based on Eagle Peak projections, proposed increase is anticipated to be exempt from additional CEQA review.

At the March 11 Board meeting, District and Eagle Peak partnered with District for adding a 2nd classroom to the Measure C project. Since then, Eagle Peak has indicated that budgetary constraints, coupled with the absence of a lease/land use agreement would preclude them from moving forward at this time. However, Eagle Peak seeks District approval to install a DSA approved mobile modular unit to accommodate enrollment increase. Eagle Peak is initiating a capital campaign to finance a more permanent facility at the site. During the campaign, Eagle Peak is requesting relocatable classroom remain for a longer period of time. The Division of State Architect has indicated a relocatable building meeting all certification requirements, as well as DSA review and approval, may be eligible to remain on site for longer periods. Based on this interpretation, Staff recommends proceeding with the DSA approval process. As owner of the property on which Eagle Peak is situated, Board action is required for placement of one additional 1440 square foot, DSA certified, relocatable mobile modular building for 2013-14 school year, to be replaced with a permanent structure once financing is in place (Currently projected by Eagle Peak as 5 -7 years). All associated costs of relocatable building will be at Eagle Peak’s expense.

Eagle Peak has also attached a 5 year budget forecast indicating their ability to pay for an additional structure.
