On May 21, 2012 Board Meeting, the Board approved facility enhancements for Northgate High School. As part of this greater approval the Board approved the New Sports Medicine Facility, New Restroom Building and Pool, known as the Northgate Aquatics Center. Because the installation of the Aquatics Center will be inspected by the Department of the State Architect, staff requests that the Board adopt a resolution, pursuant to Government Code Section 53094(b), to render inapplicable the City of Walnut Creek zoning ordinances which would otherwise apply to the Northgate High School Aquatics Center project. Government Code section 53094(b) provides that a school district, by a vote of two-thirds of its members, may render city or county zoning ordinances inapplicable to a proposed use of property when such use is not for non-classroom facilities. The proposed Aquatics Center project will serve an important function in the instruction, educational and extra curricular activities of the students and staff thereby supporting the District's educational purpose and mission. Accordingly, the exemption permitted by Government Code section 53094(b) is appropriate for the proposed use.
