As part of the Proposition 39 facilities requirements, the Board is required to determine how the radio station should be used while the Charter School operates at the current Clayton Valley High School premises. Staff considered the following options, all of which assume the COE will continue funding the radio classes, including a portion of the teacher’s FTE:
(a) Relocating the radio station to another high school: No other high school was interested in committing site funds to relocate the radio station and tower;
(b) Allowing the Charter School to run the station and assume responsibility for teaching the radio classes sponsored by the Contra Costa County Office of Education (“COE”) Regional Occupation Program (“ROP”): The radio station license is an asset of undetermined but undisputed value. As the owner of the radio license, the District will be legally responsible for any inadvertent misuse of this valuable asset and thus, it is legally prudent for the District to maintain control of the station; or
(c) Retaining District control of the operation of the station and retain responsibility for teaching the ROP classes.

Recommendation
:
Assuming that the COE continues to fund the radio program, including 0.4 FTE of the teacher’s salary, retain the District’s exclusive use and control of the station and the radio teaching program. Employ a radio teacher for 0.2 FTE.
