Summary:
In August 2017, Delta View Elementary School experienced a flood due to failure of a water heater located on the second floor. Flood water damaged walls, cabinets, floors and materials on the second floor as well as ceilings, walls, materials and floors on the ground level of the building. Damage caused by the water heater failure created the potential for mold and dry rot, rendering the site unsafe for occupancy.

In an emergency when any repairs, alterations, work, or improvement is necessary to any facility of public schools to permit the continuance of existing school classes, or to avoid danger to life or property, Public Contract Code § 20113 allows that the board may, by unanimous vote, with the approval of the county superintendent of schools, make a contract in writing or otherwise on behalf of the district for the performance of labor and furnishing of materials or supplies for the purpose without advertising for or inviting bids.
 
Funding:
A significant portion of the restoration will be funded by the CSAC Excess Insurance Authority.  
Fiscal Impact:
The amount of $430,000.00 has been incurred so far and $515,129.46 has already been reimbursed.  
Recommendation
Approve ratification of Emergency Resolution No. 17/18-20 for necessary repairs at Delta View Elementary pursuant to Public Contract Code § 20113.
